When a young man volunteers to go into combat because he loves his country, and then loses a good part of his health, gets jeered at when he returns home, tries to gather up the pieces and make a life for himself, it is not unreasonable to expect his government on all levels to be there for him.

This young man last night told me that he hoped that I would continue to speak out on this, as people really don't understand what is going on in OUR world, and I told him that I would consider his words .....

Which I am doing in here, right now, by continuing to speak out, regardless of the further blows that are going to land on my back and head as a result .....

If this is what comes along with the assumption of duty by an American citizen to protect and defend the lives, health and property of those in his community who are relying upon his integrity for their continued well-being, well so be that ....

In the end, as I have told these young people many times, DUTY IS DUTY .....

If you don't think you can handle it, or if you know that you are not trustworthy, then don't ask for duty to be handed to you ...

When political climbers decide to go up the ladder looking for nirvana at the top, anyone in the way is just so much trash to be kicked aside.

Coming home from Viet Nam, for example, to be reviled by people over here .....

People did not like the Viet Nam war, and they had a right to speak out ....

And wearing that uniform as I did, people equated that uniform with what they were against ...

I can't get the thought of that young Policeman crying on Christmas Day out of my mind .....

When it should have been a day of joy, instead ....

I don't think that I have ever spent a worse day in my life .....

It haunts me because I had no answers, and this young man had no solutions ....

No solutions at all ....

The law has failed .....

And that is what this young person stood for ....

Because that is who he is, in large part ...

And because I always told him to do so, as well ....

And now it is all a mockery ....

By this SUMMARY ORDER, I have been cut off from protection of law in my own home .....

By this SUMMARY ORDER, I have also been cut off from medical care, as well, at the VA Hospital, where I am no longer a human being, but a code instead, that flashes on the screen if a doctor at the VA Hospital calls up my "chart" on a computer screen at the VA Hospital, where as a disabled veteran with combat-related injuries, I should be entitled to medical care .....

And I know this, because I have witnessed it happen .....

At the VA Hospital in Albany, New York, where this false certification of mental illness by the corporate doctor in Troy was entered into MY medical records as though it were fact .....

The computer screen flashes, the doctor's eyes get big, and it begins .....

DANGEROUS ....

MENTALLY ILL ....

DANGEROUS .....

I will never know a moment's peace again, Mr. A.B. ......

And this young Policeman, who was himself a United States Marine, is unable to do a thing about that, despite knowing that the law was violated on August 22, 2001 when this corporate doctor certified me mentally ill and dangerous without ever having laid an eye on me in his life ......

IN THIS CASE, THAT IS ALRIGHT .....

That is what the UNITED STATES GOVERNMENT HAS SAID, and that is that ....

It will not be questioned .....

POTEMKIN VILLAGES

The term "Potemkin village" is also often used by judges, especially judges who dissent from the majority's opinion on a particular matter, to describe an inaccurate or tortured interpretation and/or application of a particular legal doctrine to the specific facts at issue.

Use of the term is meant to imply that the reasons espoused by the majority in support of its decision are not based on accurate or sound law and their restrictive application is merely a masquerade for the court's desire to avoid a difficult decision.

Often, the dissent will attempt to reveal the majority's adherence to the restrictive principle at issue as being an inappropriate function for a court because the decision involves more than traditional adjudication because the resolution of the case will effectively create an important and far-reaching policy decision, which the legislature would be the better equipped and more appropriate entity to address.

And here a question arises as to why I went to the Albany VA Hospital on August 22, 2001, if not to "seek psychiatric treatment", as New York State Attorney General Eliot "Big EL" Spitzer falsely alleges, and that answer is quite simple - I had to go somewhere .....

I had just fled from my home in Rensselaer County in fear of my life after being told by New York State Veterans' Service Officer and REPUBLICAN operative William "BUCK" Shea that I would "have to face the consequences" if I did not immediately turn myself into "authorities" at the Northeast Health corporate GULAG, or secure mental health facility in Troy, New York, and the VA was the only place that I could think of to go for sanctuary, where I might be safe, as it was federal property, and I was known there, or so I thought, anyway .....

I had just returned to my home on August 22, 2001 after running some errands, only to find two messages on my telephone answering machine from Robert "Bob the Marine" Reiter, the alleged Rensselaer County Veterans' Service Officer, begging me to come into his office in the Rensselaer County Office Building, because" he felt so bad, and had to talk to me", in his words .....

Now, this is someone who had told me about two weeks earlier that he was going to "hurt me" if I were to try and press matters concerning my continuing investigation of corruption in the Rensselaer County Department of Health, and so, suffice to say, I was real curious as to why this Reiter was calling me on the morning of August 22, 2001 ....

So I called him .....

And got some song-and-dance about how he needed to talk to me, but that it could not be over the phone .....

I had to come into the Rensselaer County Office Building, instead .....

Which was an ambush site, ready and waiting .....

At this time, REPUBLICAN Rensselaer County Executive Kathleen Jimino had the Rensselaer County Office Building "locked down", with people entering the building being told that I was "coming in to start killing people", and she had police stationed in wait to capture me, had I been so stupid as to do as Reiter wished, which was to have me come into that trap on my way to "talk" to him ....

When it became clear to Reiter on the morning of August 22, 2001 that I was not going to come into the Rensselaer County Office Building to "talk to him", Shea, who was listening in on the conversation, came on the line as if he were some kind of Lieutenant Colonel or Major General ordering around a raw recruit, telling me the trouble that I was in, etc., and at that point, I knew that they had dispatched someone out to my house to apprehend me, although I did not know for what, other than that I was being accused of being mentally ill and dangerous by Shea, and Reiter, as well .....

SO .....

Not knowing what else to do, and being in fear of my life, literally, I fled ......

GET OUT OF RENSSELAER COUNTY .....

GET OUT NOW ......

That is all I could think of ....

Was to get out .....

It was not until I was crossing the Patroon Island bridge out of Rensselaer County that I gave any real thought to where I was going, and then, it was another "crisis" of sorts, because I could not just drive around ....

And I could not go back home ....

Not without knowing what was going on, anyway ....

And so, by process of elimination, I opted for the VA Hospital, not knowing that it was a trap, as well ....

And had been since the afternoon of the day before, when Reiter, Shea and another Rensselaer County REPUBLICAN operative named Andrea Gallerie began the "set-up" there that resulted in my incarceration on August 22, 2001, the day following .....

That "set-up" involved Gallerie, a nurse, making false claims to VA staff, including Dr. Charles Kennedy, from whom I thought I would receive sanctuary, that I was a "psychiatric patient" of hers who had flipped out and become dangerous .....

When Kennedy told her and Reiter and Shea that I should be incarcerated if that was the case, then they took that and "boot-strapped" that upwards until they had secured the "direct admission paperwork" they wanted from the corporate doctors at Northeast Health in Troy on the 22nd of August, the day the "psychiatric take-down" actually went down .....

It is believed that Reiter, Shea and Gallerie co-opted Kennedy on the 21st of August out of a belief that I might try and get to Kennedy, a Viet Nam veterans' advocate, on the 22nd if I were to escape their traps in Rensselaer County ....

That Reiter, Shea and Gallerie had discussed this incarceration of myself with Kennedy is, of course, a matter of record ......

That is not in the record because like everyone else involved in this incarceration at the VA on August 22, 2001, Kennedy was told by "attorneys" to not say a word .....

Without a subpoena, Kennedy was to stay mum, even though he knew that laws had been violated, and an injustice had been done .....

An act of moral cowardice ......

An attorney, that is, whatever that in fact may be ....

And as an attorney, Eliot Spitzer would be the very first to know that something unlawful occurred here on August 22, 2001, because as New York State Attorney General, Eliot Spitzer is responsible for CONSTITUTIONALITY in the State of New York, meaning that he is responsible for seeing that the laws of the State of New York are adminstered in such a manner as to provide protection of law for ALL citizens of the State of New York, equally ....

And yet, despite that duty, or responsibility to the Constitution of the State of New York and the laws which derive from it, Eliot Spitzer never challenged any of that unlawfulness in this particular case ....

To the contrary, Eliot Spitzer gravitated over towards Northeast Health, and a deal was done ....

Northeast Health would plead that what it did on August 22, 2001 was CONSTITUTIONAL, and the State of New York would not make a challenge of those assertions ....

Even though the laws of the State of New York had been violated, and blatantly so .....

The attorney for corporate doctor John Christian Braaten and Northeast Health swore out an affidavit where he admitted that on August 22, 2001, Braaten had certified a direct admission for myself pursuant to New York State Mental Hygiene Law 9.39 and 9.40 .....

And thus a fact was established in the record, and indelibly so ....

And with that fact established, there was then one question of law to be addressed and one only ....

Was Braaten's certification lawful?

And that answer is clearly no ....

Because those sections of law REQUIRE the doctor certifying that a person is mentally ill and dangerous to have that person physically before him, so the doctor can do a physical and mental examination, before so certifying .....

Which Braaten never did in this case ....

Since I was never there ....

He never saw me ....

And yet he certified me mentally ill and dangerous, just the same ....

In complete violation of the law ....

And thus, my constitutional right to be free from fear of unlawful seizure ....

Which was violated by Braaten on August 22, 2001 ....

This is no rocket science here ....

One does not need a Ph.D or Juris Doctor degree to know these things .....

In fact, it is really pretty "see Dick run" kind of stuff ....

Which the law is supposed to be ...

If it to be understood by the common person ...

And adhered to, as a law should be in a civilized society ....

ALBANY -- The state Republican Party is asking for an investigation into a claim by a former Wall Street executive that Attorney General Eliot Spitzer threatened him in a private conversation, an accusation Spitzer has denied.

Last week, John Whitehead, the appointed chairman of the state Lower Manhattan Development Corp., wrote an opinion piece in The Wall Street Journal in which he accused Spitzer of having threatened him by telephone eight months before.

The conversation wasn't taped and there were apparently no witnesses, but Whitehead cited what he said were his own notes of the conversation.

He quoted Spitzer as saying:

"I will be coming after you."

"You will pay the price" for publicly criticizing Spitzer's investigation of an ally, insurance magnate Maurice Greenberg.

Spitzer has accused Greenberg of misleading investors of American International Group Inc. through improper accounting.

Greenberg has suffered an embarrassing fall from AIG amid widening federal and state probes of accounting irregularities.

Now state Republican Party Chairman Stephen Minarik is calling on the Manhattan district attorney's office to investigate the claim against Spitzer, the only announced Democratic candidate for governor in 2006.

Minarik, who called the allegation "serious and troubling," also claimed the attorney general should be charged with coercion.

"No threats were issued," said Darren Dopp, a spokesman for Spitzer.

"We have not received a letter and there is no investigation," said Sherry Hunter, a spokeswoman for the Manhattan district attorney's office.

Whitehead is a supporter of Greenberg.

Greenberg's nonprofit Starr Foundation has given $25 million to the foundation in charge of building the World Trade Center memorial.

Greenberg is on the board of the World Trade Center Memorial Foundation and Whitehead is chairman of that board.

And it is pretty slick, when you think on it ....

It is a story about what did happen to one man in America who went into "public service" in America .....

And you don't sell out those others who are depending upon your integrity to protect and safguard their lives, health and property .....

In Rensselaer County in the State of New York, YOU DO SELL OUT YOUR PUBLIC TRUST, OR YOU WILL BE CRUSHED .....

And that is what we are talking about in here ....

In 1986, April, give or take, a man in the State of New York who was licensed in that state as a professional engineer to protect and safeguard life, health and property in the State of New York received a telephone call from a man named Kenneth Van Praag, the purported Rensselaer County Public Health Director and head of the corrupt Rensselaer County Department of Health in Troy, New York, a small city on the east bank of the Hudson River, north of New York City, and across the river from Albany, New York, the capital of the state ....

"We need an engineer, would you be interested," Van Praag said .....

In reply, the engineer asked Van Praag whether he needed an engineer, or a licensed professional engineer, because they are not the same thing, at least in the State of New York, supposedly ....

"Oh, they told us we had to get a licensed engineer ...", said Van Praag ....

And stop right there, said the engineer ....

"WHO told you that you HAD to get a New York State licensed professional engineer, and WHY ...."

"What do you need the services of a licensed engineer for?"

And that answer was simple - the State of New York had cut off the funding for the environmental health programs of the Rensselaer County Department of Health because of corruption ....

And the County of Rensselaer wanted that money ...

And so ....

A condition to regain that money had been placed upon them by the "state", and Rensselaer County was not happy about that, at all ....

Rensselaer County WANTED the corruption, instead ....

BECAUSE THERE IS NO MONEY IN INTEGRITY .....

ALL THE MONEY IS IN GRAFT, INSTEAD .....

Gain a position of public trust, something to do with law enforcement, or code enforcement, and then SELL PASSES ...

FREE RIDES .....

For a price, of course .....

EXCEPT .....

This one engineer disdained to play the game .....

"If you want the mess cleaned up," said the engineer, "that is one thing ...."

"But I have lived here, and I know what is going on, and so, why should I immerse myself in that sewer of Rensselaer County politics ..."

"OH, NO, NO, NO ....," said Van Praag ......

"There will be no politics involved ....."

And that was a false statement, then, and now .....

Of course there is politics involved ....

Rensselaer County had its funding cut off because of "politics", and any attempt to get that funding restored was going to have to take those "politics" into consideration, because any attempt to get that money restored was going to have insure that the "politics" of the past were stamped out, at least as far as their "grip" on the Rensselaer County Department of Health was concerned .....

And what Rensselaer County wanted was someone who would come in from "outside", which is to say, by all appearances, from outside the sewer of local politics, and then "assure" people that all was now well, while in the meantime, keeping the corruption going with himself as a "PLAYER" .....

A LIAR is what Rensselaer County wanted .....

Someone without integrity .....

Someone who would look the citizens of Rensselaer County in the face, and lie to them that their health department was on the job, keeping them and theirs safe, when in fact, the Rensselaer County Department of Health was not doing its job of keeping groundwater in Rensselaer County safe and secure at all .....

And this is all a matter of public record, of course ....

Thousands upon thousands of pages, by now ....

Is it a unique story in OUR America?

That is hard to tell, of course .....

But is is true, nonetheless, if largely unsung .......

On August 22, 2001, to finally get rid of this engineer, the County of Rensselaer had John Christian Braaten, a man practicing CORPORATE MEDICINE for Northeast Health, Inc. in Troy, New York make out a fruadulent certification that this engineer was mentally ill and dangerous, so that Rensselaer County could then have a New York State Police SWAT Team take this man down, hard, placing him in four-point restraints in front of the gaping eyes of the "neighborhood" for transport to the secure mental health facility that Northeast Health, INC. runs in Troy, where this engineer was to be incarcerated, and TREATED as a mental patient, which is to say, his mind was to be destroyed ....

But Rensselaer County blew it ....

And the man got away .....

Temporarily, anyway .....

For once the net is cast, who really can run far enough to be outside its perimeter when it falls?

And this man was not trying to run away ...

This man was trying to run towards .....

Towards what he thought would be sanctuary on federal property in the city of Albany, New York, that being the Stratton VA Hospital where this person should have been safe and welcome as a disabled Viet Nam veteran with an identity card from the United States identifying him as such ....

But there was to be NO SANCTUARY that day .....

Nor ever again for this one man ...

Or at least, not here in the UNITED STATES OF AMERICA, anyway, where this man was born as one of its citizens ....

When this man went into the VA Hospital in Albany, New York on the morning of August 22, 2001 and identified himself by name, he was told point-blank that he was wanted by the police, that he was in trouble, that he was not to move from that spot that he was standing on, and the rest is history .....

OR IS IT, REALLY?

OR IS IT A FANTASY THAT HAS BEEN WRITTEN, INSTEAD, AND THAT BY THE COURTS OF THE UNITED STATES ITSELF, SO AS TO PRESERVE CORRUPTION AS A WAY OF LIFE IN AMERICA, WHILE AT THE SAME TIME INSURING THAT THE DISEASE OF INTEGRITY NOT BE ALLOWED TO SPREAD FROM THIS ONE MAN TO OTHERS IN THE FEDERAL NORTHERN DISTRICT OF NEW YORK .....

And besides one old man in America named Mr. A.B., who alone seems to have any sense of shock and outrage at injustice left in him, does anyone in America even give a damn ......

For in a SUMMARY ORDER which was just published on the INTERNET by the Federal Second Circuit Court of Appeals in New York City in this matter, the Court holds that on August 22, 2001, this engineer was mentally ill and dangerous DESPITE HAVING NO EVIDENCE whatsoever that such is the case ...

NO EVIDENCE .....

Because there is none ....

But notwithstanding, the COURT issued its DECREE, anyway ....

"LET ALL WHO LOOK UPON THIS MAN FROM THIS TIME FORWARD KNOW THAT WE, THE COURT OF THE UNITED STATES OF AMERICA DO HOLD THIS MAN TO BE MENTALLY ILL AND DANGEROUS ......"

That is a DECREE .....

Or a PRONOUNCEMENT, perhaps ...

And certainly, a CONDEMNATION .....

BY INTENT TO HAVE IT BE SO ......

THE RIGHT OF THE UNITED STATES OF AMERICA TO PUNISH THOSE WHO JUST WON'T DO WHAT THEY ARE TOLD ...

Even when what they are told to do is a clear violation of law that will harm the health and well-being of the very people that the licensed engineer was supposed to be watching over ......

That is what we are talking about in here ...

Although to be truthful, my position becomes more and more that it is a waste of breath to even try ....

A die has certainly been cast here, and that is a fact ......

Despite the presence of some words on a piece of paper called the "law", which has really been MADE A MOCKERY OF WITH THIS SUMMARY ORDER, in the State of New York, a person can be DECLARED MENTALLY ILL AND DANGEROUS by a CORPORATE DOCTOR who has never even seen the person, or examined them, and THERE IS NOW NO RECOURSE .....

Say someone has some property, and you want that property ...

You go and "buy" the right telephone number, you make a call, you denounce this person, and then, they are gone ....

"Judge censured for coming to work drunk"

ALBANY -- A Kingston judge faces censure by a state committee after appearing in court as a lawyer and judge while drunk.

The state Commission on Judicial Conduct, in a ruling issued Thursday, found that Judge James Gilpatric, an alcoholic, had abstained from drinking for 10 years before a relapse on Sept. 1, 2004.

On that day, he appeared in court as an attorney and later as a judge.

An intoxicated Gilpatric was unable to preside in court and was relieved of his duties.

Censure is a public criticism short of removal.

Gilpatric entered a 21-day residential treatment program soon after, and he has refrained from drinking since then, often going to Alcoholics Anonymous meetings, the commission said in its ruling.

"We recognize that alcoholism is an insidious disease from which judges are not exempt and we acknowledge (Gilpatric's) rehabilitative efforts," the commission said.

"However, the public is entitled to a judge who does not come to court while under the influence of alcohol, and litigants should not have to wonder whether a judge has fallen off the wagon on a particular court date."

Gilpatric's attorney, James Long, did not immediately return a call for comment.

"Walls' failure fatal in storm - Toll in New Orleans from Katrina indicates poor construction, upkeep of canal structures doomed hundreds of people"

NEW ORLEANS -- Nearly 600 people who died because of Hurricane Katrina might have survived had floodwalls on two New Orleans canals not collapsed, a Knight Ridder analysis of where bodies were found after the storm indicates.

The bodies of at least 588 people were recovered in neighborhoods that engineers say would have remained largely dry had the walls of the 17th Street and London Avenue canals not given way -- probably because of poor design, shoddy construction or improper maintenance -- after the height of the storm.

In contrast, 286 bodies were recovered in the Lower Ninth Ward, New Orleans East and neighboring St. Bernard Parish, where Katrina's storm surge poured over levees and flooded neighborhoods.

The role of the 17th Street and London Avenue canal floodwalls in the destruction of New Orleans is still being debated.

Engineers who are investigating their collapse think that floodwaters generated by Katrina never rose high enough to pour over the walls, and they blame flawed design, construction or maintenance for the walls' failure and the flooding that followed.

Louisiana authorities are investigating whether laws were broken during construction of the floodwalls, but until now there's been no attempt to quantify how much their failure may have contributed to New Orleans' death toll.

Louisiana State University hurricane expert Ivor Van Heerden said there was no doubt that vast areas of the city would have remained dry, and residents relatively unscathed, had the walls of the 17th Street and London Avenue canals not collapsed.

"A big yes," Van Heerden replied to an e-mail question asking whether the majority of the city would have stayed largely dry had those floodwalls held.

Peter Nicholson, an associate professor of civil and environmental engineering at the University of Hawaii, said some flooding in central New Orleans came from breaches on the west side of the Industrial Canal, but that those breaches were above sea level and the flooding stopped as Katrina's surge died down Aug. 29.

"The big difference is with 17th Street and London the breaches opened gaps that were below sea level and continued to drain Lake Pontchartrain until they were closed," Nicholson said.

This confounded rescue efforts and left thousands stranded in darkened hospitals, attics, on freeway overpasses or in the Superdome and the convention center.

Dr. Frank Minyard, the Orleans Parish coroner, has estimated that 20 percent of Katrina's victims drowned.

Scores more died awaiting rescue, trapped by floodwaters.

The causes of death for many will never be known because their bodies were too badly decomposed by the time they were recovered.

Said Robert Bea, a professor of civil and environmental engineering at the University of California at Berkeley, "Had we not lost the integrity at 17th Street and the integrity on London, we would have had water in there and maybe some soggy carpets, but certainly not the water level that ultimately led to the catastrophe."

" That is directly attributable to those two sets of failures."

Bea is a member of a team of engineers who studied the levee system under the auspices of the National Science Foundation.

Experts still are debating how the tragedy might have been avoided.

Local officials ordered an evacuation of New Orleans, but perhaps not soon enough.

Tens of thousands of residents ignored the evacuation order.

Federal help came slowly.

Debate also continues over what part Louisiana's fractured system for governing the levees played in the flooding.

In addition to the two canals whose floodwalls collapsed, engineers reported poor maintenance and construction practices at scores of places throughout the vast levee system.

Louisiana officials still are tabulating the death toll, which stands at nearly 1,100 statewide.

Dr. Louis Cataldie, the state medical examiner, said a precise total might never be known.

"We feel we may have lost people to the river," he said.

"We feel we may have lost people into the marshes."

"We feel we may have lost people into the Gulf" of Mexico.

Of the bodies that have been recovered, only 565 have been released to families for burial.

Of those, 422, or about 75 percent, were from New Orleans, and 104, or about 18 percent, from St. Bernard Parish.

Officials have given the identities only of victims whose bodies have been released.

The Louisiana Department of Health and Hospitals, in response to a request from Knight Ridder, earlier this month released a list of nearly 600 locations where at least 874 bodies had been recovered in Orleans and St. Bernard parishes, the two areas in Louisiana that Katrina hit the hardest.

Louisiana health officials say the list is incomplete, and a review of the data showed some inaccuracies.

But the addresses provided the first comprehensive view of where Katrina's New Orleans victims were found and allowed a systematic look at the dead for the first time.

The addresses showed that far more dead were recovered in western and central New Orleans than in the city's eastern neighborhoods, even though the Lower Ninth Ward, New Orleans East and St. Bernard Parish received the storm's harshest battering.

They showed that far more deaths were reported at hospitals and nursing homes in western areas of the city -- 171, or 79 percent -- than in the eastern portions -- 45, or 21 percent.

The number of dead recovered outside health institutions, primarily from private homes, also was higher in west and central New Orleans than in the east; 354, or 59.5 percent, were retrieved in the west, compared with 241, or 40.5 percent, in the east.

Another 63 bodies were recovered at two mass collection points in west and central New Orleans, where people had deposited them for retrieval by authorities.

He himself had been ordered to get his *** out of Rensselaer County and to stay out, and he was going to heed that order, because he wanted to keep his job ..

"Water problems find way to court - Highland Hills residents file federal lawsuit over shallow well problems"

Wilton residents who claim they have faced water shortages for 20 years in their homes have filed a lawsuit in federal court.

The Highland Hills Neighborhood Association, a group of 34 homeowners, is suing the developer, John Staalesen, and the companies he represents.

The town of Wilton, the Town Board, the Planning Board, three building inspectors, and husband and wife real estate agents Mary and Robert Buchalski from Realty USA in Saratoga Springs are also named.

Cheryl Roberts, the lawyer for the neighborhood association, said Staalesen installed shallow wells outside the Colonial- and Cape Cod-style homes he began building in 1980, instead of drilling wells 25 feet or deeper.

The wells drew surface water instead of ground water, resulting in an inconsistent source.

The lawsuit, filed in U.S. District Court in Albany, alleges Staalesen conspired with real estate agents to defraud home buyers, a violation of the federal racketeering law.

There are 49 three- and four-bedroom homes in Highland Hills.

The first houses sold for the mid-$100,000 range; more recently built houses were priced in the mid-$200,000 range.

Each sits on about an acre of land.

Roberts alleges the town knew about the situation but ignored it.

Supervisor Art Johnson referred questions to the town attorney, who declined comment.

The Buchalskis referred questions to Al Picchi, vice president and general manager of Realty USA, who declined comment.

In May, Roberts filed a lawsuit in state Supreme Court on behalf of eight property owners, alleging failure to provide water.

Last month, the state Department of Health held an administrative hearing to review 38 violations, each tied to the installation of a shallow well instead of a drilled well.

The Health Department is seeking the maximum penalty of $2,000 per violation, spokeswoman Claire Pospisil said.

The state also demanded that Staalesen fix the water problems at each house.

Staalesen's lawyer, Matthew Mazur, did not comment on the lawsuit but spoke about the recently concluded investigation by the state Health Department.

"Drilled wells were not required."

"What he did was in consultation with the town and a score of well builders," Mazur said.

And there we all were, crowded into a smallish conference room in the Rensselaer County Office Building for what was being billed by the land developers in Rensselaer County as the "TRIAL OF THE CENTURY", and before it all was to be over, which was really March 31, 2005, in Federal District Court for the Northern District of New York, in Albany, New York, it ended up being quite a marathon, indeed, although up until now, it was a story only a veritable handful of people even know transpired, involving such giants in New York State as Dr. David Axelrod, the controversial State Health Commissioner appointed by Democrat Mario Cuomo, versus Joseph "Big Joe the HAMMER" Bruno, a powerful REPUBLICAN New York State Senator from Rensselaer County who directly opposed Dr. Axelrod's efforts to clean out the corruption in the Rensselaer County Department of Health, and who further had the CLOUT to blow Dr. Axelrod "right out of the saddle", and to thereby make him into an OBJECT OF DERISION in Rensselaer County, which was to happen on March 16, 1989, but that was in OUR future yet, as of February 13, 1989, when We, and the FBI, and all the press and media for quite a distance around Troy, New York, were crammed in that conference room, listening raptly as the TRIAL OF THE CENTURY began!

How a licensed professional engineer in the State of New York with a duty to protect life, health and property in the state was "converted" over into being an alleged dangerous mental patient with the stroke of the pen of a judge placed on the federal bench in the Northern District of New York by REPUBLICAN George W. Bush and the United States Senate .....

And why that had to be ...

Why this engineer had to be "converted" over into being allegedly mentally ill and dangerous by George W. Bush's court, despite there being absolutely no evidence at all to back up this false assertion ....

At least from the perspective of "power", which is what this little tale is really all about as well ...

And money ....

For power without money is like having a car with a big souped-up engine, but no wheels on which to roll .....

The story starts in rural Rensselaer County in upstate New York where Joseph "Big Joe the HAMMER" Bruno, the head of the REPUBLICANS in the New York State Senate holds sway as the man in charge ....

Of everything .....

All the rackets in Rensselaer County belong to the "HAMMER", and so, the game is played his way ...

Which is what at least one F.B.I. agent involved in this little drama back in 1989 found out to his chagrin ....

The story involves a disabled Viet Nam combat veteran who came back to here from Viet Nam in 1970, and put himself through school so as to become an engineer in the State of New York, in the field of public health, so as to be able to help people in a positive fashion ......

In 1986, this individual received a telephone call from then-REPUBLICAN Rensselaer County Public Health Director Kennth Van Praag asking this individual to come in to the position of Director of Environmental Health for Rensselaer County, because the State of New York had cut off funding for those County Health Department programs due to gross corruption in the Rensselaer County Department of Health, all of which is a well-documented matter of record in the State of New York and so ...

And this person was supposed to clean up that corruption, so as to get the money spigot turned back on again ....

EXCEPT .....

That is not totally true .....

Yes, the county did want the money restored, BUT ....

The "county" wanted the corruption to continue .....

And so ...

A contest ensued .....

And now, the engineer has been declared mentally ill and dangerous by the courts of the United States of America, and that is that .....

And now, the lawyers and politicians are howling ....

"Oh, Livyjr, that is just so self-serving ...."

"You don't have any evidence of that ...."

"You're just saying that, because you are disgruntled ..."

Lawyers and cheap politicians just love that word ....

Because I happen to be one of the residents of Rensselaer County who is affected by this on-going corruption up here in the State of New York that was just given a huge boost, or shot-in-the-arm by this federal court ruling in this matter, and I am certainly discontented with that, although helpless, as are others similarly situated, to do a thing about it, other than to tell this story ...

And to embellish it with the actual facts, as I go ...

Such as this sworn testimony of REPUBLICAN Van Praag above that this engineer in question is mentally ill and dangerous because he told another licensed professional engineer in the State of New York that:

"I should like to take this opportunity to remind you that your obligation to any clients you may choose to represent in this county would be to assist them in evaluating their parcels for compliance with existing codes, AS OPPOSED TO INSTILLING IN THEM A BELIEF THAT THE CODES CAN BE CIRCUMVENTED WHEN PROPER SITE CONDITIONS DO NOT PRESENT THEMSELVES."

Up here in the corrupt REPUBLICAN EMPIRE of New York, we just cannot be having that, you see, engineers acting in a professional manner in accordance with ALL federal, state and local laws, rules and regulations which govern the practice of engineering in the State of New York ......

According to the precedents established by the federal court rulings that we are discussing in here, rulings that were CHAMPIONED by New York State Attorney General Eliot "Big EL" Spitzer, himself, licensed professional engineers in the State of New York exist ONLY to INSTILL IN THEIR "CLIENTS" A BELIEF THAT THE CODES CAN BE CIRCUMVENTED WHEN PROPER SITE CONDITIONS DO NOT PRESENT THEMSELVES, and people like REPUBLICAN Van Praag hold positions of "public trust" in the State of New York to ensure that when these engineers INSTILL this belief in their clients, that the engineers will then be able to follow through, to "get" their "CLIENTS" what those clients really do want, which is a "FREE PASS", and that is what this thread is all about ....

That on-going practice, and how it has been able to survive for thirty years, now, give or take, despite laws, rules and regulations to the contrary, like the federal Hobbs Act, which is supposed to be on the books to stamp out public corruption in places like Rensselaer County and the State of New York .....

But did not in this case, because an attorney in the office of the United States Attorney for the Northern District of New York shut down that investigation tight, and saw to it that not only was evidence of corruption destroyed, but that the witness was too ...
