At one point, you will hear the voice on the audio saying: "Who are you going to show that video to?"

And what he was saying was true, Roger Murdock ...

The assault that you are listening to in that video is a real assault filmed in real time as it happened in Rensselaer County on August 7, 2001 ...

That video that you are listening to is in the possession of and has been listened to by the Rensselaer County District Attorney's Office, the NYS Police BCI, the New York State Attorney General, the Office of the U.S. Attorney for the Northern District of New York, Rensselaer County Court Judge Patrick McGraph .....

AND ...

Bush-appointee Gary L. Sharpe of the federal district court for the Northern District of New York ....

Upon viewing that video in the YouTube URL above, and after reading the sworn affidavit of an Albany Police Officer which accompanied it, it was the opinion of Rensselaer County Court Judge McGrath that state and federal crimes had been committed in the matter, and he stated so in writing, as he is required to do as a judge in NYS when confronted with evidence of the commission of crimes, to the Rensselaer County District Attorney, the New York State Attorney General and the U.S. Attorney for the Northern District of New York, ALL OF WHOM blew him off like he was nothing more than a little, puny, powerless pipsqueak ...


Federal Court Judge Gary L. Sharpe also blew him off and ruled in 2005 that the person committing the assault in that video was a PROTECTED PERSON in Rensselaer County, and hence, was immune to the operation of law in Rensselaer County in the State of New York ...

The person making the assault in the video, the PROTECTED PERSON, never even had to appear in court before Judge Sharpe ...

Judge Sharpe made his motions for him, and then granted them in his capacity as judge ...

PROTECTION, Roger Murdock ...

In Rensselaer County, it is obtained through a lawyer as a BAGMAN making DISBURSEMENTS for you ...

And as this case clearly demonstrates, in New York State, and in the federal Northern District of New York, that PROTECTION is worth every dime that you have paid for it ...

Win or lose, and hopefully, it is the former and not the latter, I am pleased as a Rensselaer County resident to have had an opportunity to cast a vote for a man of proven integrity as is Judge Patrick McGrath ...

TROY -- Democratic Rensselaer County Judge Patrick McGrath appeared to hold a commanding lead this morning in the race for state Supreme Court in the Third Judicial District.

According to unofficial results, McGrath had outpolled incumbent Republican Justice Anthony Carpinello in the three largest and most urban counties in the seven-county district by nearly 20,000 votes in Albany, by more than 11,400 votes in Ulster and more than 14,000 votes in both men's home county of Rensselaer.


With 72 percent of districts reporting, McGrath was leading Carpinello, according to unofficial returns, 130,447-102,912.

McGrath this morning said he had not heard from Carpinello but expected those margins to increase as the final numbers are tallied.

The race ignited heated debate over the controversial practice of cross-endorsing incumbent candidates for state Supreme Court.

In the past, it has been common for Democrats to endorse Republican candidates, and vice versa, paving the way for uncontested judicial races that some decried as undemocratic.

McGrath and his supporters this year maintained a deal had never been struck to give Carpinello the Democratic line to aid his re-election to a second, 14-year term.

"That was my whole campaign, to give the people a choice and not let the political bosses decide," McGrath said.


Carpinello defeated McGrath in Schoharie County a much smaller part of the district by 3,030 votes.

He also was leading in Greene County 10,202 to 7,215 with 50 of 52 districts reporting.

The two men drew essentially even in Columbia County, according to elections officials there, with Carpinello winning by an unofficial tally of just seven votes, 11,537 to 11,530.

In Sullivan County, McGrath beat Carpinello by 1,196 votes, 11,896-10,700.

Carpinello's apparent defeat is significant not just because he was an incumbent but because just two years after he was elected in 1994 he was assigned to the prestigious Appellate Division by Gov. George Pataki.

Gov. David A. Paterson will now be called on to appoint McGrath's successor on the Rensselaer County bench.

Rensselaer County Democratic Chairman Tom Wade said he would convene a committee to evaluate applicants and make a recommendation to the governor.

Wade said he hadn't yet considered who might replace McGrath.

"It's an impressive win for Judge McGrath, and I hope it puts to rest the notion that incumbent judges should be automatically cross-endorsed for re-election," Wade said.

"The voters deserve choices on election day."


Wade also stressed that McGrath's win was driven by more than riding the coattails of Demcratric President-elect Barack Obama.

McGrath, Wade pointed out, won Rensselaer County by 2.5 times the 5,424-vote margin Obama received.

Well, for every ethical attorney (judge) who makes the news -- there are likely more than 1,000 who get no print for just doing their jobs every day...representing their clients in municipal court for speeding tickets they should not have received...working in a legal aid office, helping their client to buy a home...winning a personal injury case against an insurance company or better getting a settlement without the expense of trial...helping a whistleblower get his job back from his employer...getting a polluter to do the environmental cleanup he has been fighting for years...or getting a corporation to pay the fines for violating the law... --- etc. --

That may or may not be so, tazvil04, although you are certainly free in here to believe it to be so, if it makes you feel better about the world you find yourself living in these days ....

As to us and Judge McGrath up here, this letter of his right above here makes it patently clear that he was concerned that state and federal crimes were committed up here in connection with the INTIMIDATION of our expert witness in this matter ....

As a matter of law in NYS, Judge McGrath was required to make a report of his concerns ....

BUT ..

The LAWYERS to whom he was supposed to report were all COMPLICIT in the commission of the crimes - the Rensselaer County District Attorney who is a lawyer, the New York State Attorney General who is a lawyer, and the U.S. Attorney for the Northern District of New York who is a lawyer ....

And without them, the alleged crimes could never have been committed in the first place ....

And they got no print, either, for having "done" their jobs ....

And so ...

GO FIGURE, tazvil04 ....

Looking at this from the dispassionate perspective of a court martial proceeding ...

When Sotomayor says: "Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life" ....

The question that arises in my mind is:

HAS THAT THESIS OF HERS EVER BEEN TESTED IN REAL LIFE WHILE SHE HAS BEEN A FEDERAL JUDGE?

And that answer is in the AFFIRMATIVE, BLUE, in at least one case which came before her for what is called de novo review, which is a fresh look at a case from front to back, supposedly, anyway ....

And that case was the case of disabled Viet Nam veteran Paul R. Plante ...

Specifically, we are talking about a July 13, 2004 letter from Rensselaer County Court Judge Patrick McGrath concerning his review of the same evidence that was before Sotomayor in November of 2005 in federal court in NYC ...

That letter from Judge McGrath was at p.456 of the 609-page RECORD submitted to Sotomayor in the Plante appeal by Rensselaer County Executive Kathleen Jimino ..

That McGrath letter states as follows:

"This will acknowledge the court's receipt of your letter dated July 9, 2004, and the attachments thereto, all of which I have reviewed."

"Needless to say, your allegations are disturbing, especially as they encompass potential federal, as well as state, criminal charges, in that they include, among others, an allegation of false imprisonment in a federal facility, Stratton VA Medical Center."

Now, it cannot be argued in good faith that Patrick McGrath is anything other than a WHITE MALE ...

He is not pasty white, but the dude is clearly white, if you ever saw him and he is a male ....

And what Rensselaer County Executive Kathleen Jimino wanted Sotomayor to do in that Plante appeal was to take another look through the eyes of a "wise Latina woman with the richness of her experiences" at the evidence which Judge McGrath had looked at to conclude that Rensselaer County Executive Kathleen Jimino was allegedly involved in state and federal crimes in connection with the false imprisonment of Plante in a federal facility, Stratton VA Medical Center ...

And Jimino wanted Sotomayor, through the eyes of a "wise Latina woman with the richness of her experiences", to reach a better conclusion for Rensselaer County Executive Kathleen Jimino than a white male like Patrick McGrath who hasn't lived that life could reach ....

WHICH IS TO SAY, MAKE THE EVIDENCE OF HER ALLEGED STATE AND FEDERAL CRIMES THAT McGRATH HAD REVIEWED GO AWAY ....

And the rest is history, BLUE ....
