Report: FCC Sues WQYK Over Unpaid Fine

TAMPA -- May 22, 2009: The FCC has filed suit against CBS Radio -- under former name Infinity Broadcasting -- demanding payment of a $10,000 fine levied against WQYK-FM/Tampa, the Tampa Bay Business Journal reports.

The matter dates back to 2004, when WQYK and an Entravision TV station at the same Park Tower facility were each fined $25,000 for failing to notify visitors that they were being exposed to more than the maximum allowable radio frequency radiation. The fines were later reduced to $10,000.

Infinity, the Business Journal reports, responded that it was responsible for only a fraction of the radiation, saying nearly all of it came from the TV station, while Entravision argued that the rooftop location where the radiation was measured was not open to the public. The FCC rejected the arguments and affirmed both forfeiture orders in April. When a forfeiture is affirmed, entities ordinarily must pay within 30 days.
