It bothers me greatly that someone that does NOT believe in the supremacy of the Constitution may and likely will be, sitting on the Supreme Court.

So I sent the following e-messages recently:

To Sen Jon Kyl (I'm regretfully a constituent of his):

After staying glued to the tube for every word of the confirmation
hearings, I want you to know that as my representative senator I
insist that you vote no for this nominee, for the following reasons.
a) He does not oppose "Signing Statements" which are antithetical to
the Constitution, we cannot have a president that thinks he can chose
what laws he must follow.

cool.gif He subscribes to the "Unitary Executive" theory which is already
also being implemented and disabling the carefully crafted balance of
powers that must be shared co-equally as stipulated in the
Constitution.

That anyone can support such scuttling of Constitutional imperatives
is unbelievable.
But then the are so many events in the USA today that are astounding.



And to Senator Leahy as ranking member of Judiciary Cmte:



Senator, I have great respect for you and I watched 99.9% of the hearings. When it comes to the floor debate, would you seriously consider using other material in order to show how undesirable it is for our country to have this nominee on the Supreme Court.
Specifically I think the democrats should build their strategy around Alito's endorsement of "Signing Statements" and the "unitary executive concept". You can have your staff survey the blog world and see that these are matters of serious concern to the survival of the supremacy of the Constitution.
I participate on a forum called Common Ground, Common Sense, which has over four thousand members, we link in some of our topics to other forums and blogs and so this is where I am forming the idea that this is a much more serious and debatable position than the range of cases, issues etc used in the hearings.

I remain hopeful that if a vigorous - well researched and well orchestrated debate is presented on this level that there remains a chance to rescue us from the dark results that making Alito a justice will mean for us.

I asked my senator, Jon Kyl not to support Alito on the above basis, but you know what a zero chance that has!


Numer Two to Leahy:
Senator, I again implore you to consider defeat of the Alito nomination. It should be framed as a question of Constitutional supremacy, and only secondarily as an Alito opposition, more the opposition is to his destructive support of practices by the current administration that are not supported by that revered and essential document.

I have had grave concerns on this issue since the Court decision to rule on the BushVGore case and later wrote my of my concerns just prior to the pre-emptive Iraq strike.

I also think this issue qualifies this for filibustering, we must save our Constitution.

Please put all your possible efforts into defeating this nomination and possibly force the president to choose a moderate conservative as the next nominee.



And since the matter is going to the Senate floor, to the other senator from my state, McCain:

I implore you to oppose the Alito nomination. Why?
Because this man subscribes to practices that are antithetical to our Constitution. What am I referring to? "Signing Statements" ( you know, you were rolled again by Bush & Co on this) and Alito also leans far to the extreme right on the issue of "Unitary Executive" interpretations and applications.

I beg your protection and defense of our supreme document the Constitution, which the nominee will continue to diminish if he is sitting on the Supreme Court and also use your influence to obtain a moderate conservative as next nominee.

For the survival of our system, I expect no less from you.

As I've stated before, I at least get the satisfaction that I am attempting to exercise my civic obligation and maybe if thousands more would, it could make a difference.

We can all do the same- send out emails, letters, make phone calls on this and may other concerns. It is our obligation as American citizens to do so.

Another way to be heard is face-to-face. To explain to people we know what threats we see
- to help awaken the sleeping masses, so to speak. I am having a great deal of success with this by starting on small subjects (like WalMart) and working up to bigger issues. Every single mind we can influence brings us closer to stopping the madness.
