A federal judge blasted former Environmental Protection Agency chief Christine Todd Whitman on Thursday for reassuring New Yorkers soon after the Sept. 11 attacks that it was safe to return to their homes and offices while toxic dust was polluting the neighborhood.

U.S. District Judge Deborah A. Batts refused to grant Whitman immunity against a class-action lawsuit brought in 2004 by residents, students and workers in lower Manhattan and Brooklyn who said they were exposed to hazardous materials from the destruction of the World Trade Center.

"No reasonable person would have thought that telling thousands of people that it was safe to return to lower Manhattan, while knowing that such return could pose long-term health risks and other dire consequences, was conduct sanctioned by our laws," the judge said.

She called Whitman's actions "conscience-shocking," saying the EPA chief knew that the collapse of the twin towers released tons of hazardous materials into the air.

Whitman had no comment, according to a spokeswoman. A Justice Department spokesman said the government had no comment. An EPA spokeswoman said the agency was reviewing the lengthy opinion.

The judge let the lawsuit proceed against the EPA and Whitman, permitting the plaintiffs to try to prove that the agency and its administrator endangered their health.

The lawsuit seeks unspecified damages and reimbursement for cleanup costs and asks the court to order that a medical monitoring fund be set up to track the health of those exposed to trade center dust.

In her ruling, Batts noted that the EPA and Whitman said repeatedly — beginning just two days after the attack — that the air appeared safe to breathe. The EPA's internal watchdog later found that the agency, at the urging of White House officials, gave misleading assurances.

Quoting a ruling in an earlier case, the judge said a public official cannot be held personally liable for putting the public in harm's way unless the conduct was so egregious as "to shock the contemporary conscience." Given her role in protecting the health and environment for Americans, Whitman's reassurances after Sept. 11 were "without question conscience-shocking," Batts said.

Sen. Hillary Clinton, D-N.Y., said in a statement that New Yorkers are still depending on the federal government to describe any ongoing risk from contaminants.

"I continue to believe that the White House owes New Yorkers an explanation," she said.

U.S. Rep. Jerrold Nadler (news, bio, voting record), a Democrat whose district includes the trade center site, said the many people who worked at the site and developed respiratory diseases deserve answers.

"It is my assumption that thousands of people — workers and residents — are being slowly poisoned today because these workplaces and residences were never properly cleaned up," Nadler said in a telephone interview.

It is disgraceful. But is not her fault. She wanted to tell people the truth, but the White House wouldn't let her. She is just another expendable lackey who has to pay for Bush's mistake.

I know she was ordered to cover it up PP.....I meant the situation is disgraceful....but she'll probably be the fall guy....

Perhaps she was just 'following orders'. But that still leaves her bearing some of the responsibilty. That excuse didn't cut it in Germany during WWII, it doesn't cut it when it comes to US soldiers torturing prisoners, and it doesn't cut it here either.

indeed, no matter what her intention was at the time, she'll be blamed for her responsibility in that office.....it's too bad she didn't speak up... Actually I hope she provides evidence that she was instructed by bushco to conceal the facts.

Let the courts decide what responsibility she bears for her actions. But Bush is more responsible. If "I just followed orders" is reprehensible, then Bushco's "Gee, who could have predicted that?" is demonic. mad.gif

The EPA inspector general looked into this about 2 years ago. they found that EPA submitted a draft advisory to the White House for review, and the White House deleted a sentence that said the air might not be safe.

Also they initially tested the air only for asbestos, which was minimal, but they didn't test for construction dust, which was the big problem. Then they released a misleading report that said "there's no asbestos." This too was apparently at white house direction.

Yes, I remember that.....God I hate these people......I've never used this word so much in my life, but they have no regard for anyone save their closest cohorts in crime. And I wonder if they even care about them! anger.gif

Shocking and disgusting! The Bush Regime has spent $1 trillion and $2 trillion in the Iraq War - Bush originally said it would cost $70 billion, and yet Bush and his Repub controlling Congress are stinging on America! They claim that they are going after the 9/11 murderers who had killed and terrorized American citizens. Yet Bush and his Repub controlled Congress, and their incompetent Repub appointees are letting those in NY to continue to be poisoned.

Ya, modernize Iraq for the likes like the Chalabisl, and simply leave New Yorkers and those hit by Katrina live a slow death. Good God, what kind of Government do we have? Members who kiss foreign arses at the detriment of American citizens? This should be very troubling and alarming for ALL American citizens. Vote all the reckless and corrupt repubs out of the White House and the Congress! They bring terror and horror to American citizens! Bush and his cohorts are letting down American citizens!
