FindLaw guest columnist, defense attorney, and TV legal commentator Jonna Spilbor assesses recent evidence that has surfaced in the case of alleged rape by three members of the Duke lacrosse team. Two players have been indicted, but as Spilbor explains, one seems to have an airtight alibi. Spilbor notes also that the other player's defense will benefit from a series of time-stamped photos of the accuser, as well as from the prosecution's mistake in using a photo lineup that included only Duke lacrosse players. She argues that the case should be dropped.
