Ohio Recount Must Start Now


WASHINGTON -- November 18 -- Attorneys for Green Party presidential candidate David Cobb and Libertarian Michael Badnarik have sent letters to each Ohio county election director asking them to begin preparations immediately for the recount of the presidential vote. Although a demand for a recount is usually not made until after the vote has been certified, there are concerns that waiting that long would not allow enough time for the recount to be completed before the Ohio presidential electors meet on December 13 in Columbus.

The Ohio Secretary of State's office has told the press that certification of the vote would occur around December 6, allowing only a handful of days for a full recount prior to the December 13 meeting. In letters dated November 17 and sent by overnight delivery, Cobb and Badnarik's attorneys say that "such a timeframe will not allow for a meaningful recount and will undermine our clients' rights under applicable law, including Ohio recount law." Cobb and Badnarik will file the recount demand jointly. The letters go on to say that "the lack of a meaningful recount will also violate the rights under federal and state constitutional and statutory law of all Ohio citizens who cast a ballot for President on Election Day.. Immediate action is necessary so that the recount procedures may begin as soon as possible.

"This is consistent with our standing up for the right to vote and for each vote to be counted. What's the point of having a recount if it won't be completed in time? Everyone knows what happened in Florida in 2000 and no one wants to see that happen again," said Blair Bobier, Media Director for the Cobb-LaMarche campaign. Bobier said the formal recount demand and the bond of $113,600 would be officially filed on Friday. Cobb and Badnarik are represented by John Bonifaz, General Counsel of the National Voting Rights Institute and Ohio attorney Nancy Holland Myers. The Cobb-LaMarche campaign is now in the process of recruiting volunteers and raising funds for monitoring the actual recount process. They've been mailed alot about Florida and of course the Nader/Fisher/Rogers meeting and so on.....


Be interesting to see what they do...I hope the funds are opened up for sure cause I'll be donating for Florida, guaranteed getting them all in for the votes!

I still don't understand why it would take so long to certify the election there.

I thought the count was supposed to be done by the 22nd at the latest, why not certify it that day or the next???

Because the longer it is drawn out the less time there is for counting.

OK. Now you all know that *I* don't believe that anything will change THIS election.

But, I will at least toss out a bit of info that might give solace to some:

The Electoral College does, indeed, meet on December 13th.

But, Congress does not even open the ballots to certify them until January 6th.

A LOT can happen between December 13th and January 6th.

Blackwell is dragging it out so the recount will have to be done in a crunch but I also think they are cleaning up some messes.

We far outnumber them, I say we have the activists organize run in film tapes a blazing, take over and seize the polling books- After all armed attorneys fight for the truth!!

While Blackwell is free, currently, to set rules and policy on compliance with Ohio law, he is out of bounds to suggest that one's constitutional rights are second to his arbitrary decisions.

When will a federal appeals court rule on all of the elements of a brief, *****including timing******, instead of pulling a stunt as was done at 0230 hours on November 2, 2004 when an appeals court decided that challengers would be allowed in the polls (the Supreme Court was inept at following such a decision in progress in order to react swiftly to such a clearly partisan, timed decision, as they would have done in a death row appeals court decision - to think that a person on death row has more legitimate expectations for immediacy from the Supreme Court than the American people when their Democracy is under attack!)?
