Watson to order Ohio Secretary of State Kenneth Blackwell to impose uniform standards for counting provisional ballots on all 88 counties. The lawsuit cites the U.S. Supreme Court's opinion in Bush v. Gore, which "held that the failure to provide specific standards for counting of ballots that are sufficient to assure a uniform count statewide violates the Equal Protection Clause of the United States Constitution." Attorney Donald J. McTigue, who filed the suit, told me that although many of the provisional ballots are being counted, his client is concerned about those that are not being counted. Blackwell has provided only limited instruction about which provisional ballots to count. But many doubts remain about how different election boards determine whether someone is a registered voter. Some may type the name in on a computer; others may look for typographical errors; still others may look at the hard copy. McTigue worries that there is no way of knowing what each board is doing. Do they go back to the purged files? Were they properly purged?"

It seems a number of them have not only no confidence in the vote, but even republican backers are questioning the state laws which seem to be skipped over in counting these ballots.....

Where is the injunction to expedite the counting of Provisional ballots in Ohio?

Look how many votes were counted in 24 hours and compare that to how many weeks Blackwell can take to count the Provisional ballots.

It is not in the interest of either Democracy or the Election Law for Blackwell to hide behind Ohio state law or rules in order to perpetuate the provisional tally, when the recount is authorized to take place.

An injunction should be sought immediately to force Blackwell to expedite the provisional vote at once! Add the penalty of jail for Blackwell and other election officials that are interfering with the expediency of the provisional count, because delaying or taking as long as is legally permissable is to the advantage of Blackwells chosen candidate of preference.

How can a state have a law that allows five weeks to count approximately 150,000 provisional votes, and one week to count all state votes in a recount before that state's electoral votes are cast and sent to Congress?

Seems like it could be a violation of federal election law that has never been challenged, but that reeks of local cronyism in that it defeats the purpose of a recount.

Agreed, mail dan@ohiodems.org and the other organizations to seek an injunction and stop Blackwell. Even the electoral college sees overstepping here and will change their minds.

And that one week will probably also include court challenges to the recount filed by the Repubs. Blackwell is simply stretching things out as long as he can to try to stop the recount. mad.gif

Well, Blackwell can stretch, but he can't stop the river that is flowing his way. He is just going to make it worse!
