electionline.org ALERT (October 30, 2006): Voter ID back on in Ohio as Sixth Circuit grants stay
On Sunday evening October 29, the U.S. Court of Appeals for the Sixth Circuit issued a stay of the last week's order blocking enforcement of Ohio's voter ID on absentee ballots. As a result, voter ID is once again required for absentee ballots in the state. It is not clear at this point what will happen to any absentee ballots that were mailed by voters without ID in reliance on the lower court's order.
Attorneys for the groups challenging the ID law have said they will appeal the Sixth Circuit's stay to the U.S. Supreme Court. In addition, there will be another hearing Wednesday in the trial court regarding application of voter ID to in-person balloting will still take place.
The text of the Court of Appeals' stay is available at http://moritzlaw.osu.edu/electionlaw/litig...der10-29-06.pdf.
