Report Suggests Ohio Courts Won't Overturn The Results if Kerry Wins The Recount
I keep seeing this same excerpt repeated over and over again in all of the mainstream press reports. It is an Associated Press release:
Two major challenges were expected to unfold today even as the secretary of state was ready to certify the final results.
First, lawyers representing voters upset about problems at the ballot on Election Day plan to contest the results with the Ohio Supreme Court. They will cite documented cases of long lines, a shortage of machines and a pattern of problems in predominantly black neighborhoods.
In addition, third party candidates, bolstered by a favorable federal court ruling, plan to file requests for a recount in each of Ohio's 88 counties.
Observers don't give either effort much hope.
"It's an incredible long shot," said Steven Huefner, an Ohio State University law professor. "Courts are just incredibly reluctant to overturn the results of an election absent a really strong showing that something happened that affected the outcome."
First of all, the professor from Ohio State University is referring to the possible "invalidating" of the Ohio election results by the courts. However, AP continues to link this comment with the recount effort. That is a glaring mis-truth.
If the Ohio recount shows Kerry pulling ahead of Bush, then the Ohio courts (as far as I understand) have nothing to do with overturning the official results certified on December 13. This would be a matter for congress to deal with.

Don't forget to write your congressman (info in another new topic) and ask them to support the election being overturned and to stop the electorate vote for Bush until this is cleared up.

How could they refuse to overturn the vote if there is evidence of counting issues or fraud??????

I don't know if there would. Why haven't there been more people out there protesting? That's what turned things around in Ukraine. Yes, I would gladly join a protest. But I don't know if there are enough people out there who care.
I'm still in pessimism mode, so please excuse the dark clouds that are hovering around my posts tonight.

Dark clouds are rolling in for sure if a court announces its intentions before a recount, before any evidence is submitted.

Well they cheated before...can't expect them not to cheat this time. But it'll possibly push the limits of a states rights to not do so sense there are 49 other states that are involved with that outcome. Say good bye to the officials that stand behind that ruling because they will get drug down by a sea of criminal and civil law suits till they succumb to the truth.
Further more I don't think a state can in fact not overturn the out come by federal law....they better look close....it's Treason to try and over throw our Federal government. And sense we are a democracy, and sense the re-count does show that the winner is really Kerry & Edwards, that is Treason. I suggest we go ahead and arm our lawyers now with the names and actions of the "perpetrataitors" so if they do make a squiggly move well tie them up in it for the next forty years>>>!
I don’t see this as an end, I see it as an opportunity to clean house… :D

One major flaw to this statement...
The recount IS the outcome.
If they ignore a recount... they do so at their own peril.

Even if this does happen, it will be a very positive turn of events! Bush's so called "mandate/political capital" will be completely undermined. He will be a lame *uck from January 21st, 2005!!
Personally, if Ohio officials refuse to recognise the recount results, they will literally have blood on their hands, as well as their consciences.

More than that, a lot of their pollitical leadership will be tied up in courts from now till who knows how long.......
